ARTICLE 1 – SUBJECT
The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s) sold by the SELLER to the BUYER through the website www.franua.com.

(Hereinafter referred to as the “SELLER”.)

ARTICLE 3 – PRODUCTS SUBJECT TO THE AGREEMENT
The type, quantity, brand/model information, sales price, payment method, and delivery details of the product(s) are as specified on the order summary page and invoice.
The products consist of Franua branded date-based chocolate and snack food products.
Delivery Method: Delivery to the specified address via cargo/shipping service.

ARTICLE 4 – BUYER INFORMATION
The name-surname/company name, address, telephone number, e-mail address, and billing information of the BUYER are as declared during the order process.
The BUYER acknowledges and agrees that the information provided is accurate.

ARTICLE 5 – PAYMENT AND DELIVERY
5.1. The product price shall be collected using the payment method selected by the BUYER.
5.2. The products shall be delivered to the address specified during the order process, provided that the legal delivery period of 30 days is not exceeded.
5.3. In cases of force majeure (such as natural disasters, war, strikes, logistical disruptions, etc.), the delivery period may be extended. In such cases, the BUYER shall be informed accordingly.
5.4. If the product payment is cancelled by the bank or payment institution for any reason, the SELLER’s obligation to deliver the product shall cease.

ARTICLE 6 – RIGHT OF WITHDRAWAL
6.1. The BUYER may exercise the right of withdrawal within 14 days from the delivery date of the product, without providing any justification and without paying any penalty.
6.2. In order to exercise the right of withdrawal, the BUYER must notify the SELLER in writing within this period.
6.3. Within the scope of the right of withdrawal, the product must be returned to the SELLER within 14 days from the date of delivery.
6.4. The right of withdrawal cannot be exercised in the following cases:

• Perishable goods or products that may expire quickly
• Food products with opened packaging or damaged hygiene seals
• Products that are not suitable for return due to health and hygiene reasons
• Products prepared in line with the consumer’s specific requests

6.5. In order for the right of withdrawal to be valid, the product must:

• Be unused
• Have unopened packaging
• Be in a condition suitable for resale

6.6. Within 14 days following the receipt of the withdrawal notice by the SELLER, the product price shall be refunded to the BUYER using the same payment method used for the purchase.
ARTICLE 7 – INSPECTION OF THE PRODUCT
The BUYER is responsible for inspecting the product upon delivery. In the event of a damaged package, a damage report should be prepared with the cargo/shipping officer.
ARTICLE 8 – LIABILITY
The SELLER is obliged to deliver the products in a sound, complete, and proper condition, in accordance with the specifications stated in the order.

The SELLER shall not be held liable for delays or failed deliveries resulting from incorrect address information provided by the BUYER.
ARTICLE 9 – PERSONAL DATA
Personal data belonging to the BUYER shall be processed in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”) for the purposes of order processing, delivery, customer satisfaction, and compliance with legal obligations.

ARTICLE 10 – COMPETENT COURT
In the event of any dispute, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction within the monetary limits determined under the Law on the Protection of Consumers.
ARTICLE 11 – EFFECTIVENESS
By completing the order, the BUYER acknowledges, declares, and agrees that they have read, understood, and accepted all provisions of this Agreement.
